Welcome to ProWord

These Terms of Use ("Terms") govern your use of the ProWord iOS app ("the App"), provided by Oleksii Mykhalchuk ("we", "us", or "our"). By downloading or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

About the App

ProWord is a vocabulary and word learning app offering features including:

• AI-powered vocabulary flashcard creation
• Camera-based scanning to identify objects and text and create flashcards from them
• Spaced repetition system (SRS) for long-term memorization
• Quizzes and interactive word exercises
• Speech synthesis for pronunciation
• Speech recognition for pronunciation practice
• AI chat for practicing words in context
• Translation powered by multiple translation providers
• Image search for visual flashcard illustrations

Account Requirements

• An Apple Sign-In account is required to use ProWord. By signing in with Apple, you agree to Apple's Terms of Service.
• ProWord is a general-audience app and is not directed to children. We do not ask for your age. If you are under the age of majority where you live, review these Terms with a parent or guardian before using the App.
• You are responsible for maintaining the confidentiality of your account and for all activity that occurs under your account.

Subscriptions and Payments

ProWord offers free and paid subscription tiers.

• All subscription purchases and renewals are processed by Apple through the App Store's in-app purchase system.
• Subscription pricing, duration, and features are displayed in the App before purchase.
• Refunds are handled by Apple in accordance with their standard App Store refund policy. To request a refund, visit reportaproblem.apple.com or contact Apple Support. We do not process refunds directly.
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. Manage or cancel subscriptions in your Apple ID settings.
• EU and UK consumers: You may have a statutory right to withdraw from a purchase within 14 days. Because the App delivers digital content immediately, this right may not apply once delivery has begun with your consent. These statutory rights are not affected by these Terms, and are exercised through Apple as the merchant of record.

Usage Restrictions

You agree not to:

• Reverse-engineer, decompile, disassemble, or attempt to extract the source code of the App
• Use the App for any unlawful purpose or in violation of any applicable laws
• Reproduce, distribute, or create derivative works of the App or its content without our written permission
• Use automated tools, bots, or scripts to access or interact with the App
• Attempt to gain unauthorized access to our servers or infrastructure

User Content

Any content you create in the App — such as custom flashcards, word lists, collections, and photos you scan — is stored locally on your device and in iCloud associated with your Apple ID. Your account profile and device registration are also stored on our servers, as described in the Privacy Policy. You retain ownership of your content.

By submitting content to the App, you grant us a limited, non-exclusive licence to process, transmit, and store it solely to provide the App's features — including transmitting it to the third-party AI, translation, and speech providers listed below. You also represent and warrant that:

• You own the content, or otherwise have the rights necessary to submit it.
• The content does not infringe any third party's intellectual property, privacy, or other rights.
• You will not scan or upload photographs containing other people's personal, sensitive, or confidential information without their consent, and will not submit unlawful material.

We are not responsible for any loss of user-created content due to device failure, account issues, or service interruptions.

AI-Generated Content

Several of the App's features — flashcard generation, translation, example sentences, AI chat, and camera-based object and text recognition — are powered by third-party artificial intelligence services. You acknowledge and agree that:

• AI-generated output may be inaccurate, incomplete, or misleading, including incorrect translations, definitions, grammar, or object identifications.
• Output is provided for language-learning purposes only, and is not professional, medical, legal, financial, or other expert advice.
• You are responsible for verifying any output before relying on it.
• You must not use the App's AI features to generate unlawful, harmful, abusive, deceptive, or infringing content, or in any way that breaches the acceptable-use policies of the underlying AI providers.

We do not warrant the accuracy, completeness, or fitness for any purpose of AI-generated output.

Third-Party Services

The App integrates the following third-party services. Your use of these services through the App is subject to their respective terms and policies:

We are not responsible for the content, privacy practices, or terms of these third-party services.

Apple

You acknowledge that these Terms are between you and Oleksii Mykhalchuk only, and not with Apple Inc. ("Apple"). Apple is not responsible for the App or its content.

• Maintenance and support: We are solely responsible for providing maintenance and support for the App. Apple has no obligation to furnish any maintenance or support services.
• Warranty: In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) paid for the App. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the App.
• Product claims: We, not Apple, are responsible for addressing any claims relating to the App, including product liability claims, claims that the App fails to conform to any legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
• Intellectual property claims: We, not Apple, are responsible for the investigation, defence, settlement, and discharge of any third-party claim that the App infringes that third party's intellectual property rights.
• Legal compliance: You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
• Third-party beneficiary: Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you.

Intellectual Property

The App, including its design, code, graphics, mascot (Cat-Dog), and all content created by us, is owned by Oleksii Mykhalchuk and protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, logos, or brand assets.

Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.

Limitation of Liability

To the maximum extent permitted by law, Oleksii Mykhalchuk shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of or inability to use the App, even if we have been advised of the possibility of such damages.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited. If you are a consumer, you have statutory rights that these Terms do not affect, and the disclaimers above apply only to the extent permitted by the law of your country of residence.

Termination

We reserve the right to suspend or terminate your access to the App for violation of these Terms, or where required by law. Except where you are in material breach, or where immediate action is necessary to comply with law or prevent harm, we will give you reasonable notice. If we terminate your access without cause while you hold a paid subscription, you may request a pro-rata refund of the unused portion of your prepaid period; refunds of App Store purchases are issued by Apple.

You may stop using the App at any time, delete your account from Settings → Delete account, and cancel your subscription through your Apple ID settings. Upon termination, your right to use the App ceases immediately.

Modifications

We may update these Terms from time to time. We will notify you of material changes by updating the "Last Updated" date. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms.

Governing Law

These Terms are governed by the laws of Ukraine, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the jurisdiction of the courts of Ukraine.

If you are a consumer resident in the European Economic Area, the United Kingdom, or another jurisdiction whose law grants you mandatory protections, nothing in this section deprives you of the protection of the mandatory consumer-protection rules of your country of residence, and you may bring proceedings in the courts of your country of residence.

General

• Severability: If any provision of these Terms is held invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force.
• No waiver: Our failure to enforce any provision is not a waiver of our right to do so later.
• Assignment: You may not assign or transfer these Terms. We may assign them to a successor in connection with a merger, acquisition, or sale of assets, on notice to you.
• Entire agreement: These Terms, together with the Privacy Policy (incorporated by reference), constitute the entire agreement between you and us regarding the App, and supersede any prior agreements.
